Tom Brady and NFL Commissioner Roger Goodell appeared in federal court before Judge Richard Berman at Manhattan, New York on Monday, Aug. 31. No settlement was made. Berman will rule on whether or not Brady gets suspended from four games by Sept. 4.

“I have no qualms with everyone’s willingness to make it happen. In some cases, it doesn’t happen,” said Berman on Monday.

The NFL said that they were willing to reduce Brady’s punishment to a three-game suspension if he admitted guilt. Brady said that he was not guilty of being involved in the deflating NFL footballs in the AFC Championship game on January 18, 2015.

The New England Patriots quarterback said that he is only willing to be punished for not fully cooperating with lawyers during Ted Well’s investigation of the under-inflated footballs. The investigation resulted in a 243-page report on the events that lead up to Deflategate.

Berman will either uphold the NFL’s punishment of suspending Brady from four games, or he will dismiss the suspension entirely. While the judge is expected to reach a decision by Friday, he may have one by Tuesday.

Deflategate has put Brady under great media scrutiny professionally and personally. His marriage with wife Gisele Bündchen was reported to be on the rocks by OK! Magazine. While several publications report that Brady and Bündchen’s marriage is on the brink of a divorce, other sources have defended the couple.

Bündchen’s notable absence from the Patriots’ pre-season game against the Green Bay Packers at Gillete stadium on Aug. 14 stirred up more controversy. Rumors flared up when the couple did not spend time together on Brady’s birthday. Brady was reported to have been at training camp.
